The company SAS OCTOPUS DIGITAL KITCHEN, with capital of €125,000, registered in the Paris Trade and Companies Register under number 815 403 142, whose registered office is located at 13 rue de l’abbé Groult, 75015 PARIS (hereinafter “Octopus HACCP”) may, at its sole discretion, offer its customers and non-customer Internet users (hereinafter the(s) “Referrer(s)”) the opportunity to receive gift vouchers (hereinafter “Gift Vouchers”) in exchange for identifying prospects, legal entities, who are not customers of Octopus HACCP and who would become customers as a result of being put in contact by the Referrer (hereinafter the(hereinafter referred to as the “Referral(s)”) in accordance with the terms and conditions set out below (hereinafter referred to as the “Referral Program”).
1. General provisions
By participating in the Referral Program, you acknowledge that you have read and accept all of the terms and conditions of the Referral Program.
Each clause of these general terms and conditions of the Referral Program is separate. If one or more of these clauses are or become invalid (in whole or in part) under applicable law or a final court decision, they shall be deemed unwritten without affecting the validity of the other provisions of these general terms and conditions of the Referral Program.
2. Updates to the Referral Program Terms and Conditions
The amount, form, and type of Gift Cards and other rewards that may be obtained by the Referrer under the Referral Program may change at any time at Octopus HACCP’s discretion.
We reserve the right to update the terms and conditions of the Referral Program at any time without notice. If we change these terms and conditions, we will post the changes on this page. The changes will take effect immediately upon posting. If you continue to participate in the Referral Program following any changes, you will be deemed to have accepted the terms and conditions as amended.
3. The Referrer
3.1. Eligibility
In order to participate in the Referral Program, the Referrer must be a customer of Octopus HACCP. In any event, the Referrer may not be:
- an employee or former employee of Octopus HACCP,
- a family member of an employee or former employee of Octopus HACCP,
- or an employee of a Partner of Octopus HACCP.
To receive the Gift Voucher(s), the Referrer must have completed the form identifying them as a Referrer. The form, which can be found on our referral page, is also available by clicking here.
3.2. Provision of Gift Vouchers
As part of the Referral Program, Octopus HACCP provides Referrers with a referral code (hereinafter the “Code(s)”) which they are responsible for passing on to their network. The Referrer shall not disclose any data relating to the persons to whom they pass on or have passed on the Code.
Each time a new customer signs up for a valid Subscription Agreement with Octopus HACCP in accordance with our Terms and Conditions of Service using the Referral Code associated with the Referrer, the Referrer will receive a Gift Voucher, subject to the terms and conditions set out herein.
The Referrer shall be responsible for using their Gift Voucher in accordance with the terms and conditions set out by the third party offering the Gift Voucher, in particular within the time limits specified. Octopus HACCP accepts no liability in this regard.
3.3. Template(s) and sending of emails/communications
Octopus HACCP shall not be held liable in any way for any email/communication template(s) that may be provided by Octopus HACCP as part of the Referral Program. As such, the Referrer is solely responsible for sending the email/communication and for the response of its recipients.
The Referrer acknowledges that they are not authorized to send the email/communication template and/or share the referral code on a large scale with people known or unknown to them. As such, they are prohibited from using automated sending systems of any kind.
3.4. Sharing the referral code
The Referrer may only use the referral code for strictly personal and non-commercial purposes. As such, the referral code may not be used in exchange for any remuneration, nor may it be disclosed on websites intended to connect people, offer discounts or other coupons, including but not limited to:
- 1parrainage.com;
- Dealparrainage.fr;
- Parrainage-online.fr;
- Code-parrainage.net;
- Lesparrains.fr.
The Referrer may not use paid advertising to promote the referral code.
3.5. Multiple referrals
Under the Referral Program, the Referrer agrees and acknowledges that they may not, under any circumstances, receive more than twelve (12) Gift Cards worth eighty (80) euros per calendar year.
4. The Referral
4.1. Eligibility
The term “Referral(s)” refers in this document to a legal entity that meets all of the following conditions:
- Has signed up for a subscription to Octopus HACCP services in the United States after requesting a demonstration;
- Never have had any contact (by telephone or email) with Octopus HACCP, nor attended any demonstrations given by Octopus HACCP and/or signed a Subscription Agreement with Octopus HACCP in France prior to using this referral code;
- Not be part of a network of concessions and/or franchises;
- Never have signed a Subscription Agreement with Octopus HACCP in France for one or more other establishments.
4.2. Use of the Referral Code
The Referral may only use one (1) referral code. Only the Referrer associated with the referral code used by the Referral will receive the Gift Card, subject to meeting the conditions of the Referral Program.
4.3. Rewards
By becoming a customer of Octopus HACCP under the Referral Program, within the limits and conditions set forth herein, the Referral may receive the following sole reward (hereinafter referred to as the “Reward(s)”)
Fifty euros ($50) off their first subscription invoice with Octopus HACCP.
It is specified that the Reward cannot be combined with any other active promotional codes or any other discount granted by Octopus HACCP.
5. Guarantees of users of the Referral Program (Referrers and Referrals) and liability
All Referrers and/or Referrals guarantee that they are authorized to participate in and benefit from the Referral Program and that none of their legal, contractual, or professional obligations (including any internal “anti-corruption,” “gift,” or “invitation” policies) or other obligations prohibit them from doing so. They undertake to inform in advance any person or company (including their employer) who may be aware of their participation in the Referral Program, to obtain their prior authorization, if necessary, and/or to make any prior declaration.
All Referrers and/or Referrals also undertake to notify Octopus HACCP without delay if they become aware of any legal, contractual, professional or other obligation prohibiting them from participating in and/or benefiting from the Referral Program. They acknowledge that in such a case they will be excluded from the Referral Program.
The Referrer and/or Referral acknowledge that Octopus HACCP shall not be liable in any way for any breach of these obligations resulting from participation in or benefit from the Referral Program.
6. Inconsistency(ies)
If the Referrer or the Referred believes that there is an inconsistency in the allocation of Gift Vouchers or Rewards under the Referral Program, they should contact Octopus HACCP at octave@octopus-haccp.com. Octopus HACCP reserves the right to request certain information from them in order to confirm whether or not there is an inconsistency. In all cases, it is at the sole discretion of Octopus HACCP to make a decision regarding the inconsistency and to rectify the situation or not.
7. Processing of personal data
As part of the Referral Program, Octopus HACCP is required to process personal data. Octopus HACCP undertakes to comply with the legislation on the protection of personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data.

8. Termination and suspension
Octopus HACCP may suspend or terminate the Referral Program for any reason.
Octopus HACCP also reserves the right to suspend the Referrer’s participation in the Referral Program without notice and to cancel any Gift Cards and other Rewards offered, in particular in the event of abusive or fraudulent activity or violation of these Referral Program terms and conditions.
